​Last Week At the State House
 
The House Corporations Committee held, for further study, H.7089, a bill that effectively removes the ability of businesses in the retail and service industries to utilize digital coupons to market their businesses.  While the bill does not specifically ban the use of digital coupons, it does require retail and service businesses to provide consumers with a paper coupon of equal value to any digital coupon offered.  If the business violates this mandate, it is subject to a substantial fine of $2500 for the first offense and $5000 for each subsequent offense.
 
Meanwhile, the House Committee on Municipal Government listened to testimony on H.7112.  this legislation is enabling legislation allowing municipalities to waive interest on one quarter of overdue commercial property tax if:
 
  1. The property has been owned for the five years immediately preceding the tax payment that is overdue
  2. The taxpayer requests the waiver in writing
  3. The taxpayer made timely payments of taxes for the five years immediately preceding the tax payment
  4. The payment that is overdue was issued less than two years prior to the date of the request for the waiver
  5. The waiver of interest is $500 or less
 
The Chamber believes this bill could help small businesses that perhaps missed a payment inadvertently, or due to a temporary financial hardship situation.  It is another economic development tool in the tool belt of municipalities should they choose to participate.
 
This Week At the State House
 
Wednesday, January 31, 2024
 
The Senate Committee on Special Legislation and Veterans Affairs has scheduled a vote on S.2028, the bill allowing restaurants to continue to offer outdoor dining subject to continuing compliance with the state food code, and other state regulations through February 15, 2025.  The bill, as written, bars municipalities from adopting ordinances prohibiting outdoor dining, limiting the time of year outdoor dining may be offered, restricting hours of operation between 7:00 am and 10:00 pm or requiring new parking capacity standards.  The Committee may pass the bill in its current form or may amend it based on pushback that has been received from certain municipalities.  Because the current law barring municipalities from taking action against outdoor dining expires February 15, 2024, the legislature will have to act soon.
 
Thursday, February 1, 2024
 
The House Labor Committee has a busy agenda Thursday at the Rise (approximately 4:30 pm) in room 135 at the State House. 
 
H.7058, An Act Relating to Labor and Labor Relations – Posting of Veterans’ Benefits and Services, requires employers with 50 employees or more to display a poster containing information on veterans’ benefits available.  The Department of Labor and Training is charged with creating the poster and providing it to employers.  If passed, the new requirement would take effect January 1, 2025. 
 
H.7106, An Act Relating to Labor and Labor Relations – Labor Relations Act, purposes to protect the free speech rights of employees in the workplace, but it also limits the first amendment rights of employers.  H.7106 would prohibit employers from requiring non-managerial employees to attend a meeting to learn about legislative proposals or regulatory matters as well as meetings to provide information concerning labor organization efforts. What’s in the Governor’s Budget?
 
Article 2 – Relating to State Funds
 
This 13-page Article:
  • Eliminates the requirement to transfer 50% of monies left over in a fiscal year, following the annual audit, to the supplemental state budget reserve account
  • Requires proceeds from the sale of group homes owned by the State to be transferred to a new fund (Group Home Facility Improvement Fund) to be used for maintenance and upkeep of state-owned facilities under the Department of Behavioral Healthcare, Developmental Disabilities and Hospitals
  • Allows the Department of Environmental Management to create sub restricted receipt accounts as directed by the Executive Climate Change Coordinating Council to work on the requirements of the Act on Climate.
  • Creates a new restricted receipt account to handle funds associated with a donated food loss program related to the US Department of Agriculture program.
  • Creates an Electric Vehicle Charging Station Operating and Maintenance fund.  The monies in this fund are earmarked for the installation, operation and maintenance of EV charging stations on state property.  This Article also gives the Office of Energy Resources the authority to establish fees for use of the charging stations, subject to public comment.
 
 
Article 7 – Relating to Economic Development
 
 
Article 7 proposes to expand “The Innovate Rhode Island Small Business Program.” The program was created to assist small businesses apply for the federal Small Business Innovation Research and Small Business Technology Transfer program.  These highly competitive federal programs encourage small businesses to engage in federal research and development with the potential for commercialization.  The Rhode Island program is open to businesses with fifty or fewer employees where at least 51% of those employees reside in the State.  Current state law provides for two phases of funding.  The Governor proposes to increase the second phase funding from $150,000 to $300,000 and to add a third phase grant up to $500,000 per applicant.  If an applicant is successful, the business would receive 25% of the grant award at the time the award documents are signed, 65% upon request for reimbursement of eligible expenses and 10% five years following the award – only if the business stays in Rhode Island for five years following the grant award.
 
Article 7 also includes an increase in reimbursements to companies participating in the bioscience and engineering internship program.  The program was established to promote workforce development and education in the bioscience and engineering fields.  Current law provides for a reimbursement rate of $12 per hour up to $3000 per intern.  The Governor proposes to increase the rate to minimum wage ($14 per hour) with an aggregate reimbursement of up to $6,500 per intern.
 
Under the Governor’s proposal, Article 7 would allow small businesses that are employee-owned businesses and worker-cooperatives to participate in the State’s Innovation Initiative Program.  It also expands the purpose of the program to including assisting small businesses and individuals in the filing of a patent application.  The amount of the innovation grant is capped at $5,000 per awardee.
 
Lastly, Article 7 extends the sunset provision of a number of economic development programs to December 31, 2025:

Last Week At the State House
 
Governor McKee delivered his “State of the State Address” as required by the Rhode Island Constitution.  He highlighted what he considers his accomplishments and then he proceeded to outline his priorities for 2024 which included insights into items to be included in his FY 2025 budget proposal.  The Governor’s budget was formally introduced as H.7225.  As a reminder, the Governor submits the budget to the House of Representatives.  The language is then formally introduced by the House Finance Chairman, Representative Marvin Abney at this time, on behalf of the Governor; and now the House and Senate will begin to hold hearings on the 226 - page document.  We will be breaking down the budget articles of interest in upcoming editions.
 
This Week At the State House
 
Tuesday, January 23rd
 
The Senate Committee on Finance in conjunction with the Senate Committee on Environment & Agriculture, will meet at 5:00 pm in the Senate Lounge to hear a presentation from DEM Director Terry Gray and Karen Bradbury from the Office of Energy Resources.  The presentation is an update on the activities of the Executive Climate Change Coordinating Council (EC4).  The EC4 is legally bound by statutory law to adopt a plan to meet the mandatory climate change emission reduction targets.  The Chamber has been following this issue closely.  We do expect the EC4 to include, in its plan, policy changes such as building heat source conversions to electric or geothermal heat, and requiring the phase-in use of electric vehicles state-wide.  The meeting will be televised by Capitol Television on: Cox Communications, channels 15 and 61 for high definition; i3Broadband (Formerly Full Channel) on 15; and Verizon, on channel 34. Thursday, January 25th
 
Vehicle barriers at retail establishments is a topic of discussion at the House Corporations Committee at the Rise (approximately 4:30pm) in the House Lounge.  H.7084, An Act Relating to Health and Safety – Vehicle Barrier requires commercial property owners in install these barriers as part of any new construction or renovation of a retail property.  The bill “encourages” business owners to install barriers to protect pedestrians at existing properties.  Lastly the bill “asks” insurance companies to consider offering insurance discounts to businesses that install barriers.  The full language of the bill can be found at: https://webserver.rilegislature.gov/BillText/BillText24/HouseText24/H7084.pdf
 
The House Committee on Municipal Government & Housing is meeting at the Rise (approximately 4:30 pm) in Room 101.  On the agenda is H.7108, An Act Relating to Health and Safety – Refuse Disposal.  H.7108 bars trash haulers from emptying dumpsters within 100 feet of a dwelling unit between 10pm and 8am.
 
 
What’s in the Governor’s Budget?
 
Article 6 – Relating to Taxes and Fees. 
 
Article 6 addresses a variety of fee eliminations, targeted tax increases and shifting of revenues. 
 
The Governor proposes to waive a number of what he termed “nuisance fees.”  The Governor estimated the changes to the business fee portion of the elimination to save businesses about $50,000. 
Manufacturers that also must obtain a rectifier’s license or other state license to perform operations are the first mentioned in the Article.  The fee for the additional licenses would be waived $25 fee for real estate brokers and salespersons that move from one firm to another $50 filing fee for estates of decedents with a death on or after January 1, 2025 $30 surcharge added to moving vehicle violations and speeding violations (the revenue collected was allocated to the substance abuse prevention program and the school student substance abuse assistance program).  In the Governor’s briefing to the business community, it was not clear whether this portion of the fee elimination was included in the $50,000 estimate of savings.  It is unlikely that this was included in the estimate.  
 
The budget includes a reduction in the corporate minimum tax from $400 to $350 starting January 1, 2025.  The Governor’s budget office estimates this will save businesses $3 million in the next year and $6 million in the following year.
 
Anyone operating as a pass-through entity is encouraged to read page 19 of Article 6 https://webserver.rilegislature.gov/BillText24/HouseText24/Article-006.pdf  The Article changes the state tax credit definition which is the amount of tax paid by the pass-through entity level that is passed through to an owner.  The Governor proposes to change the definition starting January 1, 2025 to “ninety percent (90%) of the amount of tax paid by the pass-through entity at the entity level that is passed through to an owner on a pro rata basis.”  The Chamber is reviewing this proposed change and will provide further information in the future.
 
The State’s business combined reporting statute and business net income statute are addressed.  The language appears to allow for a net operating loss carry forward of 20 years instead of the current 10 years.  The Governor’s budget team estimates this change would save businesses between $18 million to $32 million as it is phased in over the 10 additional years.
 
For businesses engaging in the sale of e-cigarette and vaping products, the Governor proposes to change the licensing process to include these sales in the same license as regular tobacco products.  Any products sold without a license would be subject to confiscation by the state starting October 1, 2024.  The budget also includes a tax on these products equal to 80% of the wholesale cost (an exemption exists for research products).
 
The Governor proposes to increase the cigarette tax by $.25 a pack.  The language also calls for an age verification process to be adopted by online retailers of tobacco and electronic nicotine delivery systems.
 
The State Building Commissioner’s duties expands to include the annual inspection of all tent or membrane frame structures on state property.
 
Each year, the Tax Administrator is required to prepare a list of the top 100 delinquent taxpayers in the state.  The Governor’s budget expands the requirement so that the annual list will include all taxpayers to owe at least $50,000 in state taxes.
 
For individuals living on social security after reaching the full age benefit period, the Governor proposes to increase the threshold for taxation of benefits from $20,000 to $50,000 starting January 1, 2025.  This exemption only applies to individuals with certain qualified federal adjusted gross income levels.
 
Finally, Article 6 includes money for cities and towns to compensate them for the loss of the ability to collect automobile excise taxes.  The amount of reimbursement is equal to last year’s levels.

​Last Week At the State House
 
The introduction of bills has begun with 246 pieces of legislation already assigned a number.  Many are simple resolutions, while others are issues the Chamber has seen before:  raising benefits for TDI/TCI, minimum wage studies, changes to sales tax collections, etc.  Hearings on these bills are expected to begin within the next two to three weeks.
 
The legislature has also updated its website www.rilegislature.gov.  It was redesigned to be more user friendly.  If you wish to see hearing notices or bills in the old page format, press the “Bills & Laws” button to get to that page.
 
Next Week At the State House
 
Governor McKee is scheduled to deliver is State of the State Address 7:00 p.m., Tuesday, January 16th.  It will be televised and can be live streamed at www.rilegislature.gov by pressing the “Watch” button. His address is expected to include his budget plan for FY2025. The FY2025 must include changes to reflect the end of federal COVID monies.
 
Tuesday, January 16th at 5:00 pm in room 212, the Cenate Committee on Special Legislation and Veterans Affairs will take testimony on S.2028, An Act Relating to Towns and Cities – Outdoor Dining Act.  This bill seeks to allow food establishments to continue to offer outdoor dining to customers provided they comply with local rules on capacity limits, barriers bordering parking lots, curfews no earlier than 10pm.  S.2028 would ban municipalities from creating ordinances to ban outdoor dining as a general policy.  The House version, H.7064 will be heard in the House Committee on Small Business Thursday, January 18th at the Rise (approximately 4:30pm) in the House Lounge.

On Monday, January 8, 2024, Governor McKee announced that President Biden approved the State's request for federal disaster assistance in Providence County, Rhode Island to support those impacted by severe storms, flooding, and tornadoes from September 10 to 13, 2023.
For businesses impacted by the Washington Bridge closure, resources and counselors continue to be available at the Business Recovery Center at Weaver Library (41 Grove Avenue) in East Providence -- which will remain open through January 26, 2024.
Nearly 500 businesses and nonprofits have applied for Economic Injury Disaster Loans (EIDL) to date. These low interest loans are available at 4% for businesses and 2.375% for nonprofits. Customer service representatives are available to help business owners complete their applications.

FEMA assistance covers those affected in Providence County (https://www.fema.gov/disaster/4753)
SBA assistance covers Providence County, and the continuous counties of Kent and Bristol in RI; Worcester, Norfolk and Bristol.
SBA can assist small businesses with both physical damage and economic injury.
SBA can also assist individual homeowners and renters with physical damage.
SBA will set up a new Business Recovery Center exclusively for this declaration, at a location to be determined.

What Types of Disaster Loans are Available?
Business Physical Disaster Loans – Loans to businesses to repair or replace disaster-damaged property owned by the business, including real estate, inventories, supplies, machinery and equipment. Businesses of any size are eligible. Private, non-profit organizations such as charities, churches, private universities, etc., are also eligible.
Economic Injury Disaster Loans (EIDL) – Working capital loans to help small businesses, small agricultural cooperatives, small businesses engaged in aquaculture, and most private, non-profit organizations of all sizes meet their ordinary and necessary financial obligations that cannot be met as a direct result of the disaster. These loans are intended to assist through the disaster recovery period.
Home Disaster Loans – Loans to homeowners or renters to repair or replace disaster-damaged real estate and personal property, including automobiles.

The 2024 Session Begins
 
Welcome to the 2024 Subscription to Advocacy in Action.  The legislature began its session last week.  Bills are currently being filed and we expect hearings to slowly begin in the upcoming weeks. 
 
Key dates for 2024 include the following:

New Laws Now in Effect
 
We want to remind you that a few new laws went into effect as of January 1, 2024.
 
Wage Theft/Independent Contractor  - 2023 Public Law Chapters 244 and 245 – create felony penalties if an employer knowingly and willfully: (1) fails to pay employees on a regular pay day and the amount owed is over $1500,  (2) fails to pay any employee wages owed at the time of termination of employment and the amount is over $1500, or (3) fails to pay wages owed to a deceased employee to the appropriate person/entity within 30 days of death, and the amounts owed are greater than $1500.  The law adopts the Fair Labor Standards Act (FLSA) definition of independent contractor by directing the Department of Labor and Training (DLT) to review all complaints of misclassification using those factors.  The law requires DLT to undergo an investigation of complaints with the assistance of the Underground Economy Task Force.  The findings, along with a recommendation, is given to the Director of DLT who then passes it along to the Attorney General with the Director’s recommendations.  A business that misclassifies employees under the new test, is liable for civil penalties in the amount of $1500 - $3,000 for each misclassified employee for the first offense and up to $5000 for each misclassified employee for any subsequent offense.  The money is divided equally between the DLT and the individual harmed.  Any “construction industry” related entity that knowingly and willfully violates the new standard is guilty of a misdemeanor if the value is less than $1500, or a felony if the value is greater than $1500 and it is a second offense.  If the construction related business or individual misclassifies employees in a manner that is not knowing and willful, the penalty reverts back to a civil penalty of $1,500-$3,000 per misclassified employee.  Lastly, any “party” that is not an employer but intentionally contracts with an employer that intends to misclassify employees is subject to the same penalties as the employer.  Public Laws were signed by the Governor. http://webserver.rilegislature.gov/BillText/BillText23/SenateText23/S1079Aaa.pdf

Independent Contractor Registration – 2023 Public Law Chapters 242 and 243 require independent contractors to file electronically with the Department of Labor and Training (DLT) on an annual basis, “regardless of how many forms are filed.”  This would seem to suggest an annual filing for each client.  There is no fee tied to the filing requirement. DLT is required to submit the list to the Division of Taxation each April 1st. Electric Vehicle Parking Lot Infrastructure – 2023 Public Law Chapters 268 requires large employers – defined as those with 100 employees located in a single complex – to install circuitry and other necessary equipment to support Level 2 or DC fast chargers in new parking lots as well as lots undergoing a 50% expansion renovation.  The mandate also applies to big box stores, grocery stores, housing developments with more than twenty units, malls, hotels, and certain municipal buildings.  The law was amended during the final hours of session to apply only to new projects awarded subsequent to January 1, 2024, that receive any form of public funding.  Public funding is defined as “funds derived from federal, state or municipal sources; in-kind remuneration from any federal, state or municipal source; gifts or grants from any federal, state or municipal source; revenue sharing or other federal, state or municipal payments of any nature, intergovernmental transfers; tax stabilization agreements, revenues resulting from the sale of state or municipal bonds; or by the sale or lease of any property owned by the federal government, the State of Rhode Island, and/or any municipality of the state.”  http://webserver.rilegislature.gov/BillText/BillText23/SenateText23/S0988aa.pdf

It’s just another Tuesday on your way to work and you stopped by your favorite busy coffee shop to get your caffeine fix. You set your tablet down to add the cream and, when you turn back, your laptop is gone. It’s nowhere in sight, nor is the thief who stole it.
If you have a password on your laptop, it will slow the thief down; but what it doesn’t stop is someone removing the hard drive and connecting it to another computer to get access to all your files, passwords and e-mail –that’s not hard to do.
How do you protect your files? Encrypt them! With the drive encrypted, a thief can’t just pull it out, hook it up and suddenly have access to all your files. This is ESPECIALLY important if you hold or have access to medical records, credit card information or other sensitive data on your devices.
